1. Acceptance of Terms

Welcome to GUS WP Manager. These Terms of Use ("Terms") govern the use of our WordPress site monitoring and management service ("Service") operated by GUS WP ("we", "our" or "company").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Service Description

GUS WP Manager is a Software as a Service (SaaS) platform that offers:

• WordPress site uptime and performance monitoring
• Security checks and malware detection
• Centralized management of multiple sites
• Detailed reports and analytics
• Alert and notification system
• WordPress plugin for advanced integration

3. User Account

3.1 Account Creation

To use the Service, you must create an account by providing accurate, current and complete information. You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Keeping your account information updated

3.2 Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age.

3.3 Organizational Account

If you create an account on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Plans and Payment

4.1 Service Plans

We offer different service plans:

• Free: Up to 5 sites, 2 users, basic features
• Basic: Up to 25 sites, 6 users, advanced features
• Professional: Up to 100 sites, 25 users, complete features
• Enterprise: Unlimited sites, premium features, dedicated support

4.2 Billing

For paid plans:

• Billing is monthly and automatic
• Prices are subject to change with 30 days notice
• We do not offer refunds for payments already processed
• You can cancel at any time

4.3 Cancellation

You may cancel your subscription at any time. Cancellation:

• Will be effective at the end of the current billing period
• Does not result in a prorated refund
• Maintains data access for 30 days after cancellation

5. Acceptable Use

5.1 Permitted Use

You may use the Service only for:

• Monitoring WordPress sites that you own or have authorization to monitor
• Legitimate business purposes related to site management
• Compliance with all applicable laws

5.2 Prohibited Use

You may not use the Service for:

• Illegal or unauthorized activities
• Monitoring sites without permission from owners
• Attempting to access or interfere with other systems
• Distributing malware or malicious content
• Violating intellectual property rights
• Sending spam or unsolicited communications
• Reverse engineering the Service

6. Intellectual Property

6.1 Our Rights

The Service and its original content, features and functionality are and will remain the exclusive property of GUS WP and its licensors. The Service is protected by copyright, trademark and other laws.

6.2 Your Rights

You retain all rights to your data and content. By using the Service, you grant us a limited license to process your data as necessary to provide the Service.

6.3 Trademark

"GUS WP" and related logos are trademarks of our company. You may not use our trademarks without prior written permission.

7. Privacy and Data

7.1 Data Collection

We collect and process data as described in our Privacy Policy, which is an integral part of these Terms.

7.2 Data Security

7.3 Backup and Recovery

8. Service Availability

8.1 Uptime

We strive to maintain high availability, but we do not guarantee that the Service will be uninterrupted or error-free.

8.2 Maintenance

We may perform scheduled maintenance with reasonable advance notice. Emergency maintenance may occur without notice.

8.3 Technical Limitations

The Service is subject to technical limitations, including request rate limits and processing capacity.

9. Limitation of Liability

9.1 Disclaimer of Warranties

The Service is provided "as is" and "as available". We offer no express or implied warranties regarding:

• Uninterrupted operation of the Service
• Absolute accuracy of monitoring data
• Fitness for particular purposes
• Absence of viruses or other harmful components

9.2 Limitation of Damages

Under no circumstances shall we be liable for:

• Indirect, incidental or consequential damages
• Loss of profits, data or use
• Business interruption
• Damages exceeding the amount paid for the Service in the last 12 months

10. Indemnification

You agree to indemnify and hold GUS WP harmless from any claims, damages, obligations, losses, liabilities, costs or debts, and expenses (including attorney fees) arising from:

• Your use of the Service
• Violation of these Terms
• Violation of third-party rights
• Any content submitted through the Service

11. Termination

11.1 Termination by User

You may terminate your account at any time by canceling your subscription through account settings.

11.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees owed
• Use that harms our systems or other users

11.3 Effects of Termination

Upon termination:

• Your access to the Service will cease immediately
• Your data will be retained for 30 days for recovery
• After 30 days, data may be permanently deleted

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we do:

• We will notify you by email 30 days in advance
• We will post the new terms on our website
• Continued use of the Service constitutes acceptance of the new terms

13. Governing Law

These Terms shall be interpreted and governed by the laws of Brazil, without regard to its conflicts of legal principles. Any disputes shall be resolved in the competent courts of Brazil.

14. General Provisions

14.1 Entire Agreement

These Terms constitute the entire agreement between you and GUS WP regarding use of the Service.

14.2 Severability

If any provision of these Terms is found to be invalid, the remaining provisions shall remain in effect.

14.3 Assignment

You may not assign your rights under these Terms without our prior written consent.

14.4 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver.
